These Terms & Conditions govern your use of the advanceIP website and the purchase of products and services from advanceIP. They should be read together with our Shipping & Returns Policy, Warranty Policy and Privacy Policy.
By accessing or using this website, placing an order, or purchasing products or services from advanceIP, you agree to these Terms & Conditions. If you do not agree, you must not use the website or place an order.
Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified, including rights available under the Australian Consumer Law.
1. Definitions
In these Terms & Conditions:
- “advanceIP”, “we”, “us” or “our” means the business operating the advanceIP website and supplying the relevant products or services.
- “Buyer”, “you” or “your” means the person or entity accessing the website, requesting a quotation or placing an Order.
- “Order” means an offer by the Buyer to purchase products or services from advanceIP.
- “Product” means any product, software licence, accessory or related item offered for sale by advanceIP.
- “Business Day” means a day other than a Saturday, Sunday or public holiday in Western Australia.
2. Ordering
Submission of an Order through the website constitutes an offer by the Buyer to purchase the selected Products. All Orders are subject to acceptance by advanceIP, regardless of whether payment has been made.
An Order is accepted when advanceIP issues an order confirmation or otherwise confirms acceptance in writing.
If we are unable to accept an Order, we will notify the Buyer and refund any payment received for the unaccepted Order.
We may contact the Buyer to verify order details, availability, delivery requirements, compatibility or other information reasonably required before accepting an Order.
3. Prices and GST
Unless clearly stated otherwise, prices shown by advanceIP are in Australian Dollars (AUD).
advanceIP primarily supplies business and commercial customers, and prices displayed to business customers may be shown exclusive of Australian Goods and Services Tax (GST). GST at the applicable rate will be added to taxable sales and shown on the invoice.
Where pricing is displayed or offered to consumers and applicable law requires a total price to be shown, advanceIP will display or communicate the total price as required by law.
For eligible international sales, Australian GST may not apply. Any foreign duties, taxes, import charges, customs fees or local charges are the responsibility of the Buyer unless otherwise agreed in writing.
The price payable will be the price confirmed by advanceIP when the Order is accepted. Delivery, freight, insurance, installation, programming or other charges may apply where stated before acceptance of the Order.
advanceIP may change prices at any time before an Order is accepted.
4. Stock Availability and Backorders
We take reasonable care to keep stock information current. However, stock quantities and availability may change without notice.
If a Product is unavailable when an Order is processed, we will contact the Buyer to discuss a revised delivery timeframe, alternative Product or refund, as appropriate.
Some Products are not held in local stock and must be specially ordered from the manufacturer or supplier.
Estimated delivery times for backordered items typically range from approximately 3–4 weeks to 8 weeks, depending on manufacturer availability, production schedules, freight and customs clearance.
Where an Order includes backordered Products, the estimated delivery timeframe will be advised during the Order confirmation process where practicable. By proceeding after receiving that advice, the Buyer acknowledges the estimated delivery schedule.
All delivery dates are estimates only. advanceIP will make reasonable efforts to meet estimated dates but is not responsible for delays caused by events beyond its reasonable control.
This does not affect any rights or remedies available under applicable law where Products are not supplied within an agreed or reasonable time.
5. Ordering Information
The Buyer must provide complete and accurate information required to process the Order, including where applicable:
- Quantity and description of Products
- Full street delivery address; PO Boxes may not be accepted for courier deliveries
- Billing address and invoicing information
- Valid email address and contact telephone number
- Any site, compatibility, configuration or delivery information reasonably requested by advanceIP
The Buyer is responsible for reviewing Order details before submission and notifying advanceIP promptly if any information is incorrect.
6. Delivery
For Products held in local stock, delivery will normally occur approximately 3–6 Business Days after acceptance and confirmation of the Order, subject to destination, carrier availability and special delivery requirements.
Backordered, customised, programmed or special-order Products are subject to the timeframe advised in the Order confirmation.
Quoted delivery dates are estimates unless advanceIP expressly agrees in writing that a particular date is guaranteed.
If an Order has not arrived within the expected timeframe, the Buyer should contact advanceIP so that we can investigate the shipment.
Risk, title, freight claims and other delivery matters are also subject to our Shipping & Returns Policy and any mandatory rights under applicable law.
7. Payment
Payment methods available through the website may include:
- Credit card
- PayPal
- Direct bank transfer
Available payment methods may change from time to time.
advanceIP may verify payment before accepting or dispatching an Order. An automated payment receipt does not, by itself, constitute acceptance of an Order.
Where a transaction is subject to approved credit terms, payment must be made in accordance with the terms stated on the quotation, invoice or account agreement.
8. Order Cancellation
If the Buyer wishes to cancel an Order before shipment, the Buyer must contact advanceIP as soon as possible.
We will consider the request and, where reasonably possible, stop processing or shipment.
For business Orders, where permitted by law, an approved cancellation may be subject to a $50 excluding GST cancellation or processing charge, together with reasonable non-recoverable costs already incurred by advanceIP.
These costs may include supplier cancellation fees, payment processing fees, freight, handling, programming or other incidental costs.
If an Order has already shipped, our Shipping & Returns Policy applies.
Special-order, customised, programmed or non-stocked backorder Products may not be cancellable once advanceIP has committed to the supplier or commenced custom work, except where required by law or otherwise agreed in writing.
Nothing in this section limits any right to cancel, reject goods or obtain a remedy available under the Australian Consumer Law or other applicable law.
9. Returns and RMA Authorisation
Products must not be returned without prior approval from advanceIP and a Return Merchandise Authorisation (RMA) number where required.
For change-of-mind or incorrectly ordered business returns that advanceIP agrees to accept, Products must generally be:
- Unused
- In as-new and resalable condition
- In their original packaging
- Complete with all accessories, manuals and documentation
Approved change-of-mind or incorrectly ordered returns may be subject to a reasonable restocking fee together with shipping, handling, merchant or other costs incurred by advanceIP.
Special-order, customised, programmed, licensed or non-stocked backorder Products are generally non-returnable for change of mind unless advanceIP agrees otherwise in writing.
These return conditions do not restrict any rights or remedies available under the Australian Consumer Law.
10. Dead on Arrival (DOA)
If a Product appears to be Dead on Arrival (DOA), the Buyer should notify advanceIP as soon as possible and preferably within 48 hours of receiving the shipment.
This allows us to promptly assess, troubleshoot and arrange an appropriate return or replacement process.
Failure to notify us within 48 hours does not remove any statutory rights the Buyer may have.
Claims received after this period may be processed under our standard warranty or consumer guarantee procedures.
11. Products Damaged in Transit
The Buyer should inspect delivered Products promptly.
Claims for apparent transit damage should be notified to advanceIP as soon as reasonably practicable and in accordance with our Shipping & Returns Policy.
We may request photographs, packaging details, the consignment note or other reasonable evidence required to lodge a carrier claim.
The Buyer must obtain return authorisation before returning damaged Products.
12. Incorrect Supply
If advanceIP supplies a Product that does not conform to the accepted Order, the Buyer should notify us promptly and preferably within 7 days of receipt.
Where practicable, the Buyer should keep incorrectly supplied Products unused and in their original packaging while the matter is investigated.
advanceIP will arrange an appropriate remedy, such as replacement, collection, return or refund, depending on the circumstances and applicable law.
13. Product Information, Images and Compatibility
We take reasonable care when publishing Product descriptions, specifications, photographs and compatibility information.
However, manufacturers may change Product design, packaging, firmware, specifications or features without notice.
Images are for general illustration purposes. The supplied Product may differ in appearance where the manufacturer has made a revision or where an image depicts optional accessories.
Unless advanceIP has confirmed suitability in writing for a specific application, the Buyer is responsible for assessing whether a Product is suitable and compatible with the Buyer’s equipment, network, environment and intended use.
We encourage Buyers to contact our sales or technical team before purchase where compatibility is important.
Nothing in this clause permits misleading or deceptive conduct or excludes any mandatory guarantee concerning description, quality, fitness for disclosed purpose or other rights under applicable law.
14. Website Errors and Pricing Errors
We may correct typographical, photographic, technical or pricing errors on the website at any time.
If an Order has been submitted for a Product affected by a genuine and material error, advanceIP may decline the Order before acceptance.
If payment has already been received for an Order that we do not accept because of such an error, we will refund the payment.
If a contract has already been formed, our rights and obligations will be determined by the contract and applicable law.
15. Warranties and Australian Consumer Law
Products may be supplied with manufacturer warranties or other written warranties described in our Warranty Policy.
These warranties are in addition to, and do not replace, rights that cannot lawfully be excluded.
Our goods and services may come with guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, a customer may be entitled to a repair, replacement, refund, compensation or another remedy.
Please refer to our Warranty Policy for warranty claim procedures.
Requiring reasonable claim information or troubleshooting does not remove any statutory rights.
16. Limitation of Liability
Nothing in these Terms & Conditions excludes, restricts or modifies any guarantee, condition, warranty, right or remedy imposed or conferred by law where doing so would be unlawful.
To the maximum extent permitted by law, advanceIP will not be liable for indirect, special, incidental or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data or business interruption arising from use of the website, Products or services, except to the extent such liability cannot lawfully be excluded.
Where the Buyer acquires goods or services for business purposes and the law permits liability to be limited, advanceIP’s liability may, at our option, be limited to remedies permitted by applicable law, including replacement, repair, resupply or the reasonable cost of those remedies.
17. Website Disclaimer and External Links
advanceIP seeks to keep website information current and accurate but does not warrant that all website content will always be complete, error-free or current.
Website information is general in nature and should not be relied upon as a substitute for confirming critical technical specifications or compatibility.
The website may contain links to third-party websites. These links are provided for convenience only.
advanceIP does not control external websites and is not responsible for their availability, security, privacy practices or content.
A link does not necessarily constitute endorsement.

19. Intellectual Property
Unless otherwise stated, website content, branding, graphics, text, layouts and other materials are owned by or licensed to advanceIP and are protected by applicable intellectual property laws.
Manufacturer names, trademarks, logos and Product images remain the property of their respective owners.
No licence or ownership right is transferred to the Buyer merely by accessing the website.
20. Indemnity
To the extent permitted by law, a Buyer or website user who uses the website unlawfully or breaches these Terms & Conditions must indemnify advanceIP against reasonable loss, damage, liability and costs directly resulting from that breach or unlawful conduct.
This indemnity does not apply to the extent that loss was caused or contributed to by advanceIP’s own negligence, breach of contract or unlawful conduct.
It does not limit rights that cannot lawfully be excluded.
21. Events Beyond Our Reasonable Control
advanceIP is not responsible for delay or failure to perform an obligation to the extent caused by events beyond our reasonable control.
These may include:
- Manufacturer delays
- Transport disruptions
- Natural disasters
- Industrial action
- Product or component shortages
- Customs delays
- Telecommunications failures
- Cyber incidents
- Government actions
We will take reasonable steps to minimise the effect of such events and communicate material delays where practicable.
This clause does not exclude any mandatory right to a remedy under applicable law.
22. Governing Law
These Terms & Conditions are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.
Subject to any right a consumer or other party has to commence proceedings in another court or tribunal under applicable law, the parties submit to the jurisdiction of the courts and tribunals of Western Australia and courts entitled to hear appeals from them.
23. Changes to These Terms & Conditions
advanceIP may amend these Terms & Conditions from time to time.
Updated Terms & Conditions will be published on the website and will apply from the stated effective date.
Changes will not retrospectively alter an Order or contract already accepted unless the parties agree or the change is required by law.
24. Severability
If any provision of these Terms & Conditions is invalid, unlawful or unenforceable, that provision will be read down to the extent necessary or, if that is not possible, severed.
The remaining provisions will continue to apply.
